2.1 Product Description

2.2 Product Information
We strive to provide accurate descriptions, images, and ingredient information. However:
- Product images are for illustrative purposes and may vary slightly from the actual product
- Handcrafted items may have minor variations in appearance
- We reserve the right to modify recipes and ingredients without prior notice
- Allergen information is provided to the best of our knowledge; cross-contamination may occur

3. Ordering Process
3.1 Placing an Order
To place an order:
- Select your desired products and quantities
- Choose delivery or pickup option
- Provide accurate contact and delivery information
- Select your payment method (bank transfer or Payconiq)
- Review and submit your order
3.2 Order Confirmation
- You will receive an order confirmation email with your order details and payment reference
- Order confirmation does not guarantee acceptance; we reserve the right to refuse orders
- We will notify you if any items are unavailable or require substitution
- A binding contract is formed when we confirm your order and receive payment
3.3 Order Modifications and Cancellations
- Modifications: Contact us immediately at contact@cheesecake.lu or +352 661 311 255. Modifications are subject to availability and may not be possible after production begins.
- Cancellations: Orders can be cancelled free of charge up to 24 hours before the scheduled pickup/delivery time. Cancellations made less than 24 hours in advance may be subject to a 50% cancellation fee due to perishable nature of products.
- No-Show Policy: Failure to collect a pickup order or be available for delivery without prior notice will result in forfeiture of payment and the order.
4. Pricing and Payment
4.1 Pricing
- All prices are displayed in Euros (EUR) and include applicable VAT
- Prices are subject to change without prior notice
- The price charged will be the price displayed at the time of order confirmation
- Delivery fees are calculated based on distance from our location in Belvaux
4.2 Payment Methods
We accept the following payment methods:
- Bank Transfer: Payment details will be provided in your order confirmation
- Payconiq: Payment reference will be provided; send payment to +352 661 311 255
4.3 Payment Terms
- Payment must be received before order processing begins
- Orders are not confirmed until payment is verified
- Include your order reference number with all payments
- We are not responsible for payment delays caused by banking systems
4.4 Failed or Incomplete Payments
- Orders with incomplete payment information will not be processed
- If payment is not received within 24 hours, your order may be cancelled
- We reserve the right to cancel orders with payment issues
5. Delivery and Pickup
5.1 Delivery Service
Delivery Area: We deliver within Luxembourg and to select nearby areas. Delivery availability is determined by distance calculation on our website.
Delivery Fees: Calculated based on distance from our atelier in Belvaux. The delivery fee will be displayed before you confirm your order.
Delivery Times:
- Delivery times are estimates and not guaranteed
- We will provide an estimated delivery window upon order confirmation
- Delays may occur due to traffic, weather, or unforeseen circumstances
- Please ensure someone is available to receive the order during the delivery window
5.2 Pickup Service
- Pickup is available at our location: 162 Rue Waassertrap, Belvaux
- Pickup times must be scheduled in advance
- Please arrive within your scheduled pickup window
- Bring your order confirmation or reference number
- Uncollected orders will be held for 24 hours, after which they may be discarded
5.3 Perishable Goods
Important: Our cheesecakes are perishable food items that require refrigeration.
Upon receipt:
- Refrigerate immediately at 2-4°C (35-39°F)
- Consume within 3-5 days of delivery/pickup
- Do not leave at room temperature for more than 2 hours
- Check "best before" date on packaging
5.4 Delivery Refusal or Absence
- If you are not available at the delivery address, we will attempt to contact you
- If we cannot reach you or complete delivery, the order may be returned to our atelier
- Redelivery fees may apply
- Refunds will not be issued for customer absence or refusal to accept delivery
6. Returns, Refunds, and Complaints
6.1 Returns Policy
Due to the perishable nature of our products and food safety regulations, we cannot accept returns of cheesecakes once they have been collected or delivered.
6.2 Right of Withdrawal (EU Consumer Rights)
Under EU law, consumers generally have a 14-day right of withdrawal for online purchases. However, this right does not apply to:
- Perishable food items (Article 16(e) of Directive 2011/83/EU)
- Goods made to customer specifications or clearly personalized
Therefore, the right of withdrawal does not apply to our cheesecake orders.
6.3 Refunds and Compensation
You may be entitled to a refund or compensation in the following circumstances:
- Defective Products: If the cheesecake is spoiled, contaminated, or otherwise unfit for consumption upon delivery
- Incorrect Order: If you receive the wrong product or quantity
- Non-Delivery: If we fail to deliver or provide the order for pickup without valid reason
- Cancellation by Us: If we cancel your order after payment has been received
6.4 Complaints Procedure

- Do Not Discard: Keep the product and packaging for inspection if requested

6.5 Remedies
Depending on the nature of the complaint, we may offer:
- Full or partial refund
- Replacement product
- Store credit for future orders
- Other compensation as deemed appropriate
7. Liability and Disclaimers
7.1 Product Liability
- We take all reasonable care to ensure our products are safe and of high quality
- We comply with Luxembourg and EU food safety regulations
- We are not liable for allergic reactions if you have not informed us of specific allergies
- Customers with severe allergies should not consume our products without prior consultation
7.2 Limitation of Liability
